Revocation and invalidity actions

EU trademark invalidity and revocation for Chinese clients

Cancellation proceedings may be used to challenge an EU trademark that blocks a Chinese company’s market entry. They may also threaten an existing registration owned by a Chinese client. Dreyfus manages invalidity and revocation matters before the EUIPO with a clear evidence and business strategy.

Matter essentials

What the instruction requires

The sections below clarify the route, documents, decisions and local workstream for this specific matter.

Two different questions

Invalidity

An invalidity action challenges whether the registration should have been granted or should remain valid in light of earlier rights or other legal grounds. The correct grounds and standing must be assessed before filing.

Revocation

A revocation action can concern non-use or other post-registration circumstances. The registration history, relevant period, goods and services and evidence of genuine use require careful review.

When Chinese clients may need this procedure

  • a prior EU mark blocks a new application or commercial launch;
  • a registered mark appears unused for relevant goods or services;
  • a Chinese owner receives an EUIPO cancellation application;
  • ownership, bad faith or earlier-right issues affect portfolio value;
  • settlement requires a realistic assessment of cancellation exposure.

Evidence and documents

  • the contested registration and EUIPO case reference;
  • earlier rights and ownership records;
  • filing history, agreements and relevant correspondence;
  • dated sales, invoices, catalogues, advertising and website evidence;
  • territorial data connected to the European Union;
  • the client’s commercial objective and time constraints.

Our process

  1. Confirm the procedural deadline and requested outcome.
  2. Assess the grounds, standing, evidence and counterarguments.
  3. Identify evidence gaps and documents requiring explanation or translation.
  4. Prepare submissions and coordinate any settlement discussion.
  5. Report the decision, appeal options and impact on connected filings.
