Matter essentials

What the instruction requires

The sections below clarify the route, documents, decisions and local workstream for this specific matter.

Common China-Europe matters

  • clearing and filing a wine brand in France or the EU;
  • reviewing a proposed name against protected appellations and geographical indications;
  • assessing labels, packaging and origin claims from an IP perspective;
  • structuring importer, distributor, agency or licence arrangements;
  • recording ownership and permitted trademark use;
  • responding to copied labels, counterfeit bottles or misleading online listings.

Brand and appellation are different rights

A trademark identifies commercial origin. An appellation or geographical indication protects a name connected to a defined geographical origin and specification. A proposed wine brand can therefore be unavailable or risky even when no identical trademark appears in a conventional search.

We review the sign, goods, target countries, label context and protected names together before recommending a filing or use strategy.

What to send for a launch review

  • the proposed word mark, Chinese name, transliteration and logo;
  • front and back label drafts;
  • product category, origin and producer information;
  • target EU countries and sales channels;
  • importer, distributor and brand-owner structure;
  • any earlier filings, agreements or objections.

Contracts and portfolio control

The agreement should reflect who owns the brand, who may file local rights, how labels and campaigns are approved, which channels are authorised and what happens when the relationship ends. Clear ownership and exit provisions reduce the risk of distributor-filed marks and blocked market access.

Enforcement

Dreyfus can coordinate trademark proceedings, online removals, domain name action, customs measures and French litigation. The response is ranked by consumer risk, sales impact, evidence and proportionality.
