Plant variety protection for Chinese breeders in France and the EU
Dreyfus supports Chinese breeders, seed companies, agricultural groups and their professional representatives with European plant variety protection. We coordinate the legal and procedural workstream while technical information remains aligned with the breeder and testing bodies.
The Community Plant Variety Office, CPVO, manages the EU system covering all 27 member states. The CPVO states that applicants based outside the European Union must appoint an EU-based procedural representative.

What the filing strategy must coordinate

CPVO, INOV, GEVES and UPOV: which body does what?
- CPVO: manages the Community plant variety rights system and entrusts technical examinations to approved examination offices.
- INOV: receives and examines French applications, handles objections, maintains the relevant registers and issues French plant variety certificates.
- GEVES: hosts INOV and carries out technical variety and seed work. It is also an entrusted examination office for a number of species within the CPVO network.
- UPOV: provides the international framework and the UPOV PRISMA filing tool. It does not grant a single worldwide plant variety right.
For a China-to-Europe project, this distinction matters when coordinating first filings, priority, variety denominations, technical questionnaires and plant-material deadlines.

- Application: prepare the legal and administrative file with the Chinese instructing team.
- Formal review: address completeness, eligibility and representative requirements.
- Technical examination: coordinate procedural communications concerning distinctness, uniformity and stability testing.
- Variety denomination: manage the denomination proposal and any objection or replacement need.
- Grant and portfolio management: record ownership changes, licences and subsequent enforcement matters.

Plant variety protection is distinct from catalogue listing, seed certification and marketing requirements. These regulatory workstreams should be identified separately at the start of the project.

Dreyfus provides an English evidence checklist, identifies procedural gaps early and coordinates with technical specialists where required. The Chinese firm or institution retains control of scientific decisions and the client relationship.
